TERMS OF SERVICE

These terms apply to services supplied by Jonathan Kepke trading as JK PROFITNESS, 70–80 Castle View, Castletown, Sunderland SR5 3DW. Contact jkprofitness@live.co.uk or 07796 448082.

Before purchasing

You must provide accurate information, disclose relevant health or training limitations and ask about anything unclear. Online purchasing is for customers aged 18 or over. Submission of a questionnaire does not guarantee suitability or create medical clearance.

Contract and payment

Prices are shown in pounds sterling. Payment is handled by Stripe. A contract is formed when payment is accepted and an order confirmation is issued, subject to any clearly stated suitability requirement. JK PROFITNESS may contact you for clarification before work begins.

Personalised programmes

A programme is prepared from the information provided, reviewed by Jonathan and normally delivered within up to three working days. The review period may pause while essential clarification or medical clearance is outstanding. One-off programme updates are separate purchases unless expressly included.

Starting work and cancellation rights

Consumers normally have 14 days from entering a distance service contract to cancel. When you expressly ask JK PROFITNESS to begin personalised work during that period, you may be charged for work performed up to cancellation. Once the personalised service has been fully performed following your express request and acknowledgement, the cancellation right may end. Where the supplied PDF is treated as digital content, access beginning within the cancellation period requires your express consent and acknowledgement that the cancellation right may be lost once supply begins. These terms do not reduce statutory rights where a service or digital product is faulty, misdescribed or not supplied with reasonable care and skill.

Online coaching subscriptions

Standard Coaching is £130 monthly and includes one weekly review/check-in session lasting up to 45 minutes. Performance Coaching is £180 monthly and includes two weekly review/check-in sessions totalling up to 90 minutes. Unless otherwise agreed, subscriptions renew monthly and can be cancelled before the next billing date through Stripe’s customer route or by contacting Jonathan. Cancellation stops future renewal and does not normally refund a period already started, except where required by law.

Personal training

Sessions are arranged directly and are not automatically booked by payment. At least 24 hours’ notice is required to cancel or move a session. A late cancellation or non-attendance may be charged or deducted where the slot cannot reasonably be filled. JK PROFITNESS may rearrange a session and will provide reasonable notice where possible.

Health and responsibility

Services are fitness coaching, not medical diagnosis, physiotherapy or treatment. Follow safety instructions, use suitable equipment and stop if you experience sharp or worsening pain, chest pain, dizziness, unusual breathlessness or neurological symptoms. Seek appropriate professional advice where required. Progress depends on many factors and no specific result is guaranteed.

Programme use and intellectual property

Programmes and coaching materials are licensed to the named client for personal use. They must not be copied for sale, resold, published, shared as another coach’s work or commercially distributed. Reasonable personal printing and viewing are allowed.

Liability

Nothing excludes liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence, fraud, or statutory consumer rights. Subject to that, JK PROFITNESS is not responsible for losses caused by inaccurate or withheld information, unauthorised programme changes, unsafe equipment, or use outside the agreed purpose.

Complaints and law

Raise concerns promptly by email so they can be investigated. These terms are governed by the law of England and Wales; consumers retain any mandatory rights to use the courts applicable to them.
